Toca Timbre Terms and Conditions

1. Introduction and acceptance

These Terms and Conditions govern the use of the Toca Timbre mobile application and web platform ("the Application"), operated by Victor Frank Santana Lugo, Dominican Republic. By downloading, accessing, or using the Application, you accept this legally binding agreement and the rules included in the Privacy Policy available at https://tocatimbre.com/privacypolicy.

If you do not agree with these terms, do not use the Application.

2. Definitions

  • "Toca Timbre": The mobile application and web platform developed by Victor Santana.
  • "User": Any person who accesses or uses the Application.
  • "Verified Agent": Real estate professional who has passed our verification process.
  • "Property": Real estate listed on the platform.

3. Use of the application

  • Requires iOS 15.6+, iPadOS 15.6+, macOS 12.5 with Apple M1 chip or compatible Android.
  • Basic navigation without registration. Agents must complete verification process and provide accurate information.
  • Accounts and credentials are personal, non-transferable, and the user is responsible for their confidentiality and proper use.
  • Notify immediately any unauthorized use of your account.

4. How we share your information

Users can:

  • Search for properties on maps and with custom filters.
  • Contact verified agents via WhatsApp.
  • Receive automatic currency conversion and bilingual support.

Agents can:

  • Publish properties and manage their portfolio through a credits system or subscription.
  • Access verified profile, international reach, and automatic translation.

5. Credits system and pricing

  • Credits or subscriptions determine the number of active listings.
  • Basic use is free. Packages/payments will be formally announced before applying.
  • All payments made are non-refundable unless the law states otherwise.

6. Content, listings, and rules

  • The Agent is responsible for the accuracy, timeliness, and legality of published information.
  • Fraudulent, illegal, deceptive, or inappropriate content is not permitted.
  • Spam or unsolicited communications are not permitted.
  • Violating these rules may result in account suspension or closure.

7. Communications, privacy, and transactions

  • Main communications are via WhatsApp and email.
  • Toca Timbre only facilitates the connection; it does not participate in negotiations or guarantee agreements.

8. Intellectual property

  • The Application, its software, and content are exclusive property of Victor Frank Santana Lugo, except for user-generated content, which remains the property of each user/agent.
  • No license is granted except as necessary for normal app use. Reproduction, copying, modification, or distribution without written permission is prohibited.

9. Limitation of liability

  • Toca Timbre is not responsible for transactions between users or the accuracy/timeliness of listings.
  • The Platform is offered "as is", without warranties of uninterrupted availability or fitness for a particular purpose.
  • Toca Timbre's total accumulated liability, if applicable, will be limited to the amount paid by the user in the past 6 months, except for gross negligence or willful misconduct.

10. Modifications and validity

  • We may update these Terms at any time. Relevant changes will be notified through the Application, email, or on the web.
  • Continued use after changes implies automatic acceptance.

11. Applicable law and dispute resolution

  • These Terms are governed by Dominican Republic law.
  • Before going to court, the parties will attempt to resolve any dispute in good faith amicably.
